A Fall River man accused of attacking a couple with a knife in a Somerset hotel on Aug. 1 is no longer being charged with attempted murder as his case moves to Bristol County Superior Court.

 

Kyle Barboza, 43, was indicted by a grand jury on Sept. 10, moving his case to the county’s higher court.

 

He still faces two counts of assault and battery causing serious bodily injury. However, two counts of attempted murder he faced in District Court are not in his grand jury indictment.

 

Those have been replaced with two counts of assault with intent to commit assault and battery with a dangerous weapon, a felony.

 

Added to his Superior Court case are charges stemming from a separate July 5 attack on family members: one misdemeanor assault and battery charge and two counts of assault with a dangerous weapon.

 

Barboza is also facing one count of intimidating a witness, juror, police officer or court official on July 5.

 

A Superior Court date has not yet been set. A scheduled probable cause hearing for Barboza in District Court still appears on Massachusetts' online court database, but it could be canceled as indictments typically supersede probable cause hearings and end district court cases.

 

The Bristol County District Attorney’s office did not immediately respond to a request for comment.
