The owner of an 18-acre parcel on Fall River’s waterfront taken by eminent domain to build an MBTA layover station at Weaver’s Cove has labeled a recent jury verdict about the property’s value “a total miscarriage of justice,” and is seeking a new trial.

Weaver’s Cove Industrial Park LLC had sued the MBTA in 2022, saying it was paid $2.28 million for land it alleged was worth $8.2 million. However, in June, a jury determined the land was worth even less than it was originally paid, only $1.65 million. That meant Weaver’s Cove would have to pay back the MBTA almost $639,000 — with interest bringing the tab to over $755,000.

Weaver’s Cove has filed a motion in Bristol County Superior Court asking Judge Raffi Yessayan for a new trial, or to adjust the jury’s verdict, calling it “aberrant.”

“The jury verdict of $1,650,000 not only defies common sense, it tragically results in a total miscarriage of justice,” attorneys for Weaver’s Cove wrote.
